Missouri to roll out new cellphone law

 

A new law that goes into effect August 28, 2023 making Missouri the 28th state to require hands-free use and the 49th state to ban texting while driving.

Specifically, drivers will no longer be able to physically hold their phone, send or receive text messages, record audio, post to social media or other, and/or watch video.

If so equipped, drivers will be allowed to utilize voice-operated or hands-free functions that can be engaged/disengaged with a single touch or swipe, as well as talk using a hands-free feature. Likewise, use of cellphone GPS navigation will be allowed as well.

A first-time violation will result in a fine of up to $150 and can increase up to $500 for repeat convictions within a two-year period. Additional penalties may be applied but won’t start until Jan. 1, 2025.

The law is classified as secondary enforcement, similar to Missouri’s seat belt law. The classification means an officer can only write a citation after stopping the vehicle for another infraction.

The law is named after two Missourians who both died in car crashes. One being Randall Siddens, 34, of Columbia died after being struck by a driver who was actively holding and using a cellphone. Michael Bening, 46, of  Raymore was struck and killed by a distracted driver in May of this year while trying to retrieve debris in the roadway.
