Law enforcement officers re-file lawsuit at local level

After a federal lawsuit filed by three law enforcement officers and their spouses was dismissed in May, now the plaintiffs have re-filed the suit in Bates County Circuit Court.

Kenneth Rush and Lisa Rush, Mark Frost and Diana Frost, along with Harold Chad Anderson and Courtney Anderson have filed the suit against the named defendants in the federal case, being former Butler Police chief Jeff Blom, former chief Jim Garnett and the late Jerry Cook, former Mayor of Butler.

The plaintiffs are petitioning for damages after serving a search warrant on Nov. 25th, 2007 at a Butler residence suspected to contain a meth lab. The plaintiffs allege that the defendants caused them harm in failing to ensure that the plaintiffs received training in using personal protective equipment, and as a result, Frost, Anderson and Rush were exposed to toxic chemicals while executing a search warrant on an active meth lab. Upon their entrance to the residence, one of the persons in the home began pouring chemicals into the sump pump, which when mixed with water created a vapor of sulfuric acid, Coleman fuel and ammonia.

The plaintiffs allege that exposure to the fumes has caused long term health problems as they were hospitalized for chemical pneumonia and heart murmurs after the incident.

Damages sought by the plaintiffs:

1. Negligence-violated ministerial duty/failure to provide mandatory training (plaintiffs vs. all defendants): Sum in excess of $25,000 and in an amount that is fair and reasonable.

2. Negligence-bad faith/reckless breach of duty to train (plaintiffs vs. all defendants): Sum in excess of $25,000 and in an amount that is fair and reasonable.

3. Diana Frost vs. defendants-loss of consortium/services: A sum in excess of $25,000 and in an amount that is fair and reasonable.

4. Courtney Anderson vs. defendants-loss of consortium/services: A sum in excess of $25,000 and in an amount that is fair and reasonable.

5. Lisa Rush vs. defendants-loss of consortium/services: A sum in excess of $25,000 and in an amount that is fair and reasonable.

Obituary - Bill Smith

Funeral services for Bill Smith will be 10:30 a.m. Monday, June 27, 2011 at Schowengerdt Funeral Chapel (660-679-6555) in Butler, Missouri with Pastor Richard Hubbard officiating. Visitation will be Sunday afternoon from 3-5 p.m. at Schowengerdt Chapel. Burial will be 1:30 p.m. Monday, June 27, 2011 at Buckner Hills Cemetery, Buckner, Missouri. Contributions to American Cancer Society.

Billy Joe Smith, age 77 of rural Adrian, Missouri formerly of Napolean, Missouri passed away peacefully Thursday, June 23, 2011 at his home in Adrian and went to be with the Lord. He was born June 13, 1934 to Layton Doss and Corda Eurie Johnson in Taney County, Missouri.


Bill is survived by his son, Steven Smith and wife Patti of Kearney, Missouri; two daughters, Rhonda Morrison and husband Curtis of Lee’s Summit, Missouri and Kimberly Sidden and husband Dave of Holt, Missouri; grandsons, Jacob and Stetson Smith, Kyle, Christopher and Evan Morrison; granddaughters, Sage Smith and Baylee and Billee Jo Sidden; two sisters, Geraldine Thornhill of Ballard, Missouri and Betty Creath of Overland Park, Kansas; and many nephews, nieces and honorary family members who called him “Uncle Bill”--especially the John Meade and Don Camerer families. He was preceded in death by his parents; wife Imogene Smith; and one brother, Robert Smith.

A hit and miss engine churning ice cream
It's three full days of steam engines, tractors, implements and more at the 33rd annual Western Missouri Antique Tractor and Machinery Association show is officially underway at Frontier Village in Adrian. This year's featured tractor is the Ford, Fordson and related equipment co-featuring all brands of lawn and garden tractors.

The Frontier Village center will be open all weekend for breakfast and lunch each day. Here's a look at the schedule:

Accident results in minor injuries

A two vehicle accident yesterday afternoon on 71 highway affected traffic in the north and southbound lanes for a short time. Hector Marrero, 40 of Houston Texas was southbound on 71 highway when his 2005 International truck struck the the left rear bumper of a 1999 Chevrolet driven by George Hess, 71 of Clinton, Mo. The truck then traveled off the right side of the roadway, struck a ditch and overturned. Marrero was transported to Research Hospital with minor injuries.


Assisting in the investigation were the Missouri Highway Patrol, the Cass County Sheriff's office, Central Cass, Garden City, Adrian and West Peculiar fire departments.

From the desk of Senator David Pearce


It has been approximately six weeks since the budget approved by the General Assembly was sent to the governor for his review. Between the constitutional deadline and the start of the fiscal year, it becomes evident that some of the programs and services may need to be trimmed in order to keep a balanced budget. 
In my dedication to education in our state, I can’t help but feel a bit of disappointment in the numbers that have come down from this budget work. While I understand the necessity of reining spending in to avoid raising taxes, and with the serious hits to funding due to the inordinate amount of natural disasters our state has faced, much of the $172.15 million that had been withheld by the governor from the original $23.2 billion budget was from various education-related areas.
Late in the session, the Legislature worked to find funding for both two-and four-year higher education institutions, including a $12 million increase to higher education and a $10 million increase to K-12 transportation. Those numbers have since been reduced, cutting $8 million out of the $10 million for K-12 transportation. For higher education, we had accomplished cutting the governor’s proposed 7 percent reduction down to 5.4 percent, or $12 million. Those numbers were taken back to the original 7 percent cut, and even slightly higher for a few institutions.
The largest cut was made to MOHELA funds, approximately $100 million, to be used for construction projects on college and university campuses across the state in FY 2012.
During these tough economic times, we must all live within our means. Some budget items are impossible to predict. I happen to feel that natural disasters fall in that category. Funds to facilitate recovery have to be found in order for our neighbors to stand back up and find their way back to a sense of normalcy. However, it leaves a large gap in one of our top priorities, education. This is an issue that, while disappointing, cannot be helped if we are to maintain our promises to Missouri’s citizens, to not raise taxes and aid them in their time of need. In the case of the natural disasters that have visited Missouri so far this year, and the predictions of what is yet to come, I would support a special session of the Legislature to discuss utilizing the rainy day fund.
It is my hope that, as general revenue increases, the governor will release his withholdings for FY 2012.
