According to Henry County Prosecuting attorney Richard Shields, 39 year old Ian McCarthy is now due back in court Dec. 22nd for a preliminary hearing.
McCarthy is one of four individuals charged concerning the death of 37 year old Gary Michael Jr. during a traffic stop in early August but McCarthy is the one that allegedly pulled the trigger and killed Michael. McCarthy was captured without incident two days later east of Clinton.
William and Brandie Nobel and Jacob Johnson are the three others charged and their next court date is Nov. 27th.
