On 1/10/2023 the Bates County Sheriff’s Office executed a narcotics search warrant at 100 N Olive Butler Mo 64730. During the execution of the search warrant two people who live at the residence were detained at the residence.
Illegal items were recovered from multiple locations in the residence to include; a loaded syringe, spoons and glass containers with methamphetamine residue, straws with methamphetamine residue, Tin with methamphetamine residue, baggies with methamphetamine residue and multiple digital scales with methamphetamine residue.
One subject was released from the scene and the second subject was transported to the Sheriff’s Office where they were processed and released pending formal charges by the Bates County Prosecutor. These items with Methamphetamine residue constitute possession of dangerous drugs as in Missouri State Statutes.
This search warrant was the culmination of a several month long investigation into the residents of the house and many of its visitors who were there for illegal drug activities. The Detectives received information from multiple sources saying that the house was being used for a drop off point, drug use and drug sales. Following up on those tips, enough evidence was obtained to apply for and receive a search warrant for the residence.
The Sheriff’s Office is committed to continue its battle against harmful illegal drug sales and use in our communities. We have seen an increase in drug overdoses that have increased the burden on Law Enforcement, First Responders and our EMS Crews. Our Emergency Room has seen an increase in patients being presented to the ER for treatment.
The Sheriff’s Office will now use multiple tactics to combat the illegal drug use in our community. First and foremost, our continued efforts to present solid factual case evidence to the courts so they can hold the suspects accountable. Second, we will now be placing signage in the yards of the residence that are being used for illegal sales and usage of dangerous drugs after search warrants. These signs are to send a notice to those people who use their property or other people's property as a drug safe haven for sales, storage or usage of illegal dangerous drugs. Third, the Sheriff’s Office will be sending official notices to those property owners informing them that their property is being used for illegal drug activity and MAY be deemed as a public nuisance property in accordance with RSMo 579.105.
579.105. Keeping or maintaining a public nuisance — violation, penalty. — 1. A person commits the offense of keeping or maintaining a public nuisance if he or she knowingly keeps or maintains:
(1) Any room, building, structure or inhabitable structure, as defined in section 556.061, which is used for the illegal manufacture, distribution, storage, or sale of any amount of a controlled substance, except thirty-five grams or less of marijuana or thirty-five grams or less of any synthetic cannabinoid; or
(2) Any room, building, structure or inhabitable structure, as defined in section 556.061, where on three or more separate occasions within the period of a year, two or more persons, who were not residents of the room, building, structure, or inhabitable structure, gathered for the principal purpose of unlawfully ingesting, injecting, inhaling or using any amount of a controlled substance, except thirty-five grams or less of marijuana or thirty-five grams or less of any synthetic cannabinoid.
2. In addition to any other criminal prosecutions, the prosecuting attorney or circuit attorney may by information or indictment charge the owner or the occupant, or both the owner and the occupant of the room, building, structure, or inhabitable structure with the offense of keeping or maintaining a public nuisance.
3. The offense of keeping or maintaining a public nuisance is a class E felony.
4. Upon the conviction of the owner pursuant to this section, the room, building, structure, or inhabitable structure is subject to the provisions of sections 513.600 to 513.645
Our ultimate goal is to work with property owners, the judicial system and our community partners to help those who need help get the help and resources they need. Many of the people we encounter have simply relapsed and need help to get back on track to being a productive member of our community.
