Montrose fly ash contamination issue gains legal momentum

 

What started with a single lawsuit filed in January 17th by landowners William (Bill) and Sue Steward of Clinton, Mo alleging that fly ash stored on the former Montrose power plant property has contaminated soil and groundwater on their property, will now likely grow to include many more local residents.

At the heart of the matter is heavy metal and other toxins found in groundwater monitoring wells maintained by Evergy on the property. Independent testing by the Stewards and other are residents reflect similar findings, which has led to several public meetings that have been held over the past week to find a resolution.

With that, attorneys for the Stewards have been joined by other Kansas City area attorneys and while not mentioned, more lawsuits may likely lead to class action status.

During a public meeting at the Benson Center in Clinton last night, it appears more residents are seeking legal counsel and additional updates are expected in coming days.
